1. Acceptance of Terms

These Terms & Conditions (“Terms”) constitute a legally binding agreement between you (“User”, “you”, or “your”) and GoDrively (“we”, “us”, or “our”), governing your use of our ride-hailing and taxi-matching mobile application (built on React Native with Expo) and our official website.

By downloading, registering an account, booking a ride, or operating as a driver on the GoDrively platform, you explicitly agree to comply with and be bound by these Terms. If you do not agree to these Terms, you may not access or use our services.

2. User Accounts

To access most parts of our platform, you must register and maintain an active user account. Account rules include:

• Age Restriction: You must be at least 18 years old to create a rider or driver account. By signing up, you represent that you meet this requirement.
• Account Accuracy: You agree to provide and maintain true, accurate, and complete information, including your legal name, phone number, and email address.
• Security Responsibilities: You are solely responsible for maintaining the confidentiality of your account credentials (username/password) and for all activities that occur under your account. You must notify us immediately if you suspect unauthorized access.
• Single Account: Unless otherwise authorized by GoDrively, you may only hold one active account. Accounts are personal and non-transferable.

3. Nature of Services

GoDrively acts only as an intermediary platform connecting passengers who need transportation to destinations with drivers willing to provide transport. We make no representations or warranties regarding the reliability, safety, quality, or suitability of the transport services provided by drivers.

4. Location Tracking and Push Alerts

By using our application, you acknowledge and agree that GoDrively utilizes your mobile device's GPS and cellular location data to match rides, compute pickup and dropoff distances, show route maps, and compile trip logs.

You also agree that we may send you push notifications, SMS alerts, and emails related to your ride bookings (e.g. driver matching notifications, driver arrival messages, and receipts) to ensure the service runs efficiently. You can turn off marketing messages at any time in the app settings, but system alerts cannot be disabled.

5. Pricing & Payments

Fares for trips are calculated dynamically based on trip distance, duration, traffic conditions, and demand.

• Fare Estimates: The app displays a fare estimate prior to booking. The final fare may vary due to route changes, delays, or traffic conditions.
• Payment Method: Payment is typically made directly to the driver in Cash at the end of the trip, or via authorized in-app digital wallets or card integrations where supported.
• Passenger Responsibility: Riders are legally obligated to pay the driver the full amount displayed on the app upon reaching the dropoff destination. Failure to pay will lead to account suspension.
• Driver Share: Drivers agree to pay GoDrively the platform commission or subscription fee as agreed in separate driver-onboarding agreements.

6. User Conduct Guidelines

Both riders and drivers must maintain high safety and professional standards. The following actions are strictly prohibited:

• Harassing, insulting, threatening, or abusing other platform users.
• Damaging the driver's vehicle or depositing garbage inside it.
• Using the platform for illegal actions, including transporting illegal substances, weapons, or contrabands.
• Sharing your user account with other people or requesting trips for passengers without their consent.
• Attempting to manipulate the app pricing, matching algorithms, or rating systems.

Breaching these conduct guidelines will result in immediate suspension or permanent deletion of your GoDrively account.

7. Driver Obligations

If you register as a driver on the platform, you represent and warrant that:

• You possess a valid driver's license and all necessary permits, licenses, and authorizations to operate a commercial passenger vehicle in Algeria.
• Your vehicle is in good condition, passes all regulatory safety inspections, and is clean.
• You maintain valid third-party liability insurance covering commercial transportation services.
• You will not decline rides based on discrimination, and will adhere to safe driving regulations.

8. Intellectual Property

All rights, titles, and interests in the GoDrively platform (including mobile app source code, website design, trademarks, logos, texts, illustrations, and database structures) are owned exclusively by GoDrively. You are granted a limited, revocable, non-transferable license to access the app for personal use. You may not copy, decompile, modify, or exploit our intellectual property.

9. Limitation of Liability

To the maximum extent permitted by applicable Algerian law, GoDrively, its founders, and employees will not be held liable for:

• Any direct, indirect, incidental, or consequential damages resulting from your use of (or inability to use) the app.
• Any actions, misconduct, delays, theft, property damage, accidents, bodily injuries, or deaths occurring during a ride matched on the platform.
• Errors, bugs, server crashes, or temporary service interruptions of the app or backend.

10. Account Termination

We reserve the right to restrict, suspend, or terminate your access to the platform and your user account at our sole discretion, without prior notice, if we believe you have breached these Terms, violated safety guidelines, or if the platform is being discontinued.

11. Governing Law

These Terms & Conditions are governed by and construed in accordance with the laws of the People's Democratic Republic of Algeria. Any disputes, controversies, or claims arising from your use of the GoDrively app or website will be subject to the exclusive jurisdiction of the competent courts of Algiers, Algeria.
